What is the function of Professional Standards?

Professional Standards receives, processes, monitors or conducts investigations regarding employees.

How do I file a complaint against an employee of the Manatee County Sheriff’s Office?

Complaints can be accepted by any employee or supervisor or you may contact Professional Standards directly. Supervisors receiving a complaint will refer your complaint to Professional Standards. Complaints may be made in person at any of the district offices or by telephone, facsimile or letter.

How will the complaint be investigated?

When received, the complaint is classified and assigned either to the affected employees command or Professional Standards. Statements will be taken, if needed, from the complainant, witnesses and the subject employee(s). All reasonable leads will be investigated.

How will I know when the investigation is completed?

When an investigation is completed, you will be notified of the findings in writing.

How long will it take to resolve my complaint?

Professional Standards attempts to complete all assigned investigations within 60 days from the date the complaint is received. Some investigations are more complex than others.

Does the Manatee County Sheriff’s Office attempt to identify employees who may be prone to committing an act of misconduct before it occurs?

Yes. The Manatee County Sheriff’s Office has developed an early warning system designed to identify employees who may be on the verge of committing an act of misconduct. The computerized system generates names of employees who display a pattern of pre-determined behavioral indicator.

What rights do employees have if a complaint is made against them?

In compliance with Florida State Statute, under the Law Enforcement/Corrections Officer’s Bill of Rights, all employees have the right to review all complaints and witness statements prior to questioning or final resolution of the complaint. Employee investigations remain confidential until finalized. Also, under Florida State Statute, no participant including complainants, witnesses, investigated employees or investigators can disclose any information regarding the investigation until the investigation’s conclusion.

Are all complaints investigated?

Yes. All complaints against employees are investigated provided the complaint contains sufficient factual data to warrant an investigation.

Do other agencies investigate police misconduct?

Yes. The State Attorney’s Office reviews any complaint where there is a possibility an employee may be involved in violation of state law(s). Violation of federal law(s) will be referred to the appropriate federal agency.

Can I remain Anonymous?

Yes, but without sworn testimony, affidavits, or other evidence, it could possibly hinder the investigation.

If I make a complaint, will I suffer retaliation?

No. Based upon the General Orders of the Manatee County Sheriff’s Office and departmental policy, any employee who attempts to retaliate against any complainant could be subject to severe disciplinary action up to and including termination.
